Uddhav Sena to go to SC against 3 ‘rebel’ MLCs | Mumbai News – Times of India



MUMBAI: After the Supreme Court last week pulled up Maharashtra assembly Speaker Rahul Narwekar over the Shiv Sena MLAs disqualification case, the Shiv Sena (UBT) said on Friday it will move the SC seeking disqualification of three rebel Sena MLCs including the legislative council’s deputy chairperson Neelam Gorhe. Gorhe joined CM Eknath Shinde’s group in July this year.
Sena (UBT) MLC Anil Parab said Gorhe has not acted on their group’s disqualification petitions against the Sena MLCs. Chaitanya Marpakwar reports.
Gorhe can’t hear plea against herself: Parab
Stating that Shiv Sena (UBT) will move the apex court against Neelam Gorhe, Manisha Kayande and Viplav Bajoria, Uddhav Thackeray group’s MLC Anil Parab said as Gorhe herself is facing a removal petition as a result of having joined the Shi nde group, she cannot hear her own disqualification plea in her capacity as acting chairperson of the council.
A panel chairperson, he said, has to be appointed to hear the plea, which hasn’t been done, and claimed that just like MLAs, the MLCs too would be disqualified. “In the legislative council, we filed a disqualification petition against three MLCs on July 21. So there is no confusion at all. We are giving a reminder and if no action is taken, then just like in the case of MLAs, we will go to the SC. We are fully prepared. The disqualification of 39 MLAs is expected and the same will happen to the three MLCs,” Parab said. Parab said the hearing in the MLAs’ case started only after the SC pulled up the Speaker. “The SC has taken a clear stand, a hearing has to be held in one week and a schedule has to be submitted. They have also delayed things in the council,” he added. He further said, “In the case of Kayande and Bajoria, then panel chairperson Niranjan Davkhare had ruled that Gorhe can hear their disqualification plea. But we will challenge all this and if there is any delay, the SC will come down on them.
The government had said that a senior MLC will be nominated for hearing but for four months, they haven’t done anything. So we have no option but to move the SC.” At the time of sending its plea, Sena (UBT) had also sent a removal notice against Gorhe, expressing no confidence against her as deputy chairperson of council. Gorhe is holding charge of the council chairperson’s post as a chairperson hasn’t been elected yet. Kayande joined the Shinde camp in June this year, and in February, CM Shinde had issued a letter asking that Bajoria be appointed as the Shiv Sena’s whip in the legislative council. Bajoria was the first MLC from the Thackeray camp to join the Shinde-led Sena.
