Thane court sentences man to 5-year RI for wife’s death after assault | Thane News – Times of India



NEW DELHI/THANE: A man in Maharashtra’s Thane district has been handed a five-year rigorous imprisonment sentence by a court for his involvement in physically assaulting his wife, which ultimately led to her death.
Bikas Vishwanath Yadav (33) has been declared guilty by additional sessions judge Dr Rachna R Tehra.
He has been convicted under Section 325 of the Indian Penal Code for voluntarily causing grievous hurt.
The conviction was based on the testimony of his minor daughter.
The accused has been sentenced to five years of rigorous imprisonment, along with a fine of Rs 5,000 imposed on him.
A copy of the comprehensive order, dated September 12, was made accessible on Tuesday.
Additional public prosecutor Sandhya Mhatre informed the court that both the accused and his wife, Rani Raj Chavan, were residents of Shilphata in Thane district.
On September 29, 2017, the accused brutally assaulted his wife using a plastic pipe and forcefully struck her head against a wall, resulting in grave injuries that ultimately led to her demise while receiving medical treatment at a hospital.
The prosecutor argued that such actions warranted a conviction for murder on the part of the accused.
The court took into consideration that the couple’s daughter, who was seven years old at the time of the incident, had witnessed the assault, and emphasized the importance of thoroughly examining her testimony.
The court noted that during her deposition, the girl had testified that her father had engaged in a quarrel with her mother and had assaulted her with a pipe, causing her mother to lose consciousness due to a head injury.
The court acknowledged that the girl’s testimony remained steadfast and unshakable, likening her resolve to the “Rock of Gibraltar.”
The court, during the conviction of the accused, noted that there was voluntary evidence establishing a direct connection between the pipe that was seized and the injuries sustained by the deceased.
